SPECIAL NOTE ON THE PRODUCTS SOLD ON DFA WEBSITE

A person who has not consulted with Dr Mitha in person is not a patient but rather an online customer. All use of the products must be followed by the product’s instructions for application. No liability can be ascribed to the medical practitioner where there was no physical one-on-one consultation. The advice and information contained within this site is of a general nature and is not intended to constitute or replace professional advice for individual or specific conditions. While we make every effort to ensure that the information contained within this site is correct, we take no responsibility for any loss or damage arising from its use.

SECTION 1 – ONLINE STORE TERMS AND PROHIBITIONS

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws (including but not limited to copyright laws).

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse Service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.

SECTION 3 - PRODUCT ORDERS

All prices and availability of the products listed on the site are subject to change without notice. All prices and fees listed on the site are in Botswana Pula (BWP). If for any reason a price listed on the site is incorrect, whether due to an error by us, information received from a supplier, or for any other reason, we have the right to refuse or cancel any order made at the incorrect price, even if the order has been successfully submitted and payment has been made. In the event that payment has been made for the purchase and the order has been cancelled, we will refund the full amount of the incorrect price paid within a reasonable period of time.

Products purchased from our site are for personal use only and must not be resold without our express consent. By purchasing products from our site, you agree that you will not resell any products, including any part of a product. We reserve the right, with or without notice, to cancel or reduce the quantity of any order to be filled or products or services to be provided to you that we believe, in our sole discretion, may result in the violation of our Terms and Conditions.

To place orders and access some features of the site, you must register an account with us. To register an account, you must:

SECTION 5 - PAYMENT & ORDER CONFIRMATION

DFA is under no obligation to ship any goods ordered until payment for those goods has been received in full. In the event that requested goods are unavailable, we may cancel the transaction and provide a full refund. All orders placed are an offer of purchase and are subject to acceptance by DFA. If an order is not accepted, a full refund will occur at the earliest possible convenience. DFA reserves the right to refuse an offer for any reason and to refuse any order that it reasonably believes is for the purpose of resale. All prices listed are inclusive of any applicable goods and services tax.

SECTION 6 – ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete, or current. SECTION 8 – PRODUCTS OR SERVICES

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.

We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 9 – SHIPPING AND DELIVERY

We only ship domestically, using DHL Express courier service. Please allow 1-2 business days to fulfill your order, and 3-5 business days for shipping (regional areas may have a longer delivery time than Gaborone and immediate areas). Orders are subject to stock availability with suppliers and receipt of payment. Items labelled “back order” are ordered on a “payment-first” basis only, and may take up to 14-21 days to deliver. Delivery is free for orders in excess of P2000 and a courier fee applies to orders below P1999. Please also note that no P.O Box addresses will be accepted as a delivery address. Please ensure that someone will be present to accept the delivery of your order at the residential or business address provided.

The Provider will supply all goods to the delivery company in good order and will ensure that goods arrive at the User’s chosen delivery address in the same good order.

Cancelled orders on the e-commerce facility will be refunded after deduction of a 10% charge for administration costs. The Provider reserves the right to cancel an order for which payment has already been received. This may occur if stock is insufficient or the quality of goods ordered does not meet the Provider’s standards. Should the Provider exercise this right, the User will receive a full refund with no deductions.

SECTION 10 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 11 – OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor do we have any control or input.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

SECTION 18 – GIFT VOUCHERS

Gift Vouchers are not redeemable for cash and will not be replaced if lost, stolen, destroyed, or used without permission. Gift Vouchers cannot be resold to or exchanged with a third party. You cannot use a Gift Voucher to purchase another Gift Voucher. Gift Vouchers can only be redeemed online through www.dfa.co.bw

SECTION 19 – RETURNS

Due to the nature of our products being health and personal care items, we have a NO RETURNS POLICY - unfortunately, we are unable to offer you a refund or exchange. Exchanges will only be made under exceptional circumstances at the discretion of the service provider. Please email your exchange query to info@dfa.co.bw

Our return for exchange policy lasts 30 days. If 30 days have elapsed since your purchase, unfortunately, we are unable to offer you a refund or exchange.

All costs associated with exchanges are for your account. DFA takes no responsibility for any courier charges or otherwise incurred in returning an item for exchange.

To be eligible for an exchange, your item must be unused and in the same pristine condition that you received it. It must also be in the original packaging including any seals or plastic wrapping.

Several types of goods are exempt from being returned such as: Some health and personal care items.

To complete your exchange, we require a receipt or proof of purchase.

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item.

Sale items: Only regular priced items may be exchanged, unfortunately, sale items cannot be refunded or exchanged.

Exchanges: We will, at our discretion, replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at info@dfa.co.bw

Shipping: To return your product for exchange, you should courier or drop off your product to:

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable.

Depending on where you live, the time it may take for your exchanged product to reach you may vary. You are responsible for all shipping costs involved in facilitating the exchange.
